These Terms & Conditions govern your use of this website and the purchase of goods from www.anabelachan.com.  By accessing this website and/or placing an order you agree to be bound by Terms & Conditions for Use.

Where you do not accept these Terms and Conditions in full, you do not have permission to access the contents of this website, then please immediately stop using the site.

The images of the creations on our Website are for illustrative purposes only. We have made every effort to display the colours accurately, but we cannot guarantee that a device’s display of the colours accurately reflects the colour of the final creations. Please kindly note that your creations may vary slightly from those images.

ANABELA CHAN™ and www.anabelachan.com website (described as "site" or "Sites" in this agreement) and related services are made available to you to the following Terms & Conditions for Use ("TCU") and any other rules posted on our Site.

By visiting the Sites, you are accepting and consenting to the terms and practices described in the TCU. We hold the right to modify the TCU from time to time.

Your continued use of this Site (or any of our other Sites) following such change shall signify your agreement to be bound by the modified TCU. Please read our Terms & Conditions for Use and check back often. If you disagree with any changes made to the TCU, then please immediately stop using the site.

  

PRIVACY

You acknowledge and agree to be bound by the terms of our Privacy Policy, as updated from time to time.

 

CONTRACT BETWEEN YOU AND ANABELA CHAN

Before your order can be accepted we must receive payment in whole for the price of the goods that you order.

Once payment has been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide in your order form.

Our acceptance of your order brings into existence a legally binding contract between us, concluded in London, England and the language of the contract is English.

To order goods and transact through the Site, you must be legally capable of entering into binding contracts.

ANABELA CHAN reserves the right to refuse, suspend or cancel an order where reasonably necessary, including where:

• payment cannot be authorised or verified;

• fraudulent, unlawful or unauthorised activity is suspected;

• products are unavailable or out of stock;

• there has been an error in pricing, product information or website content;

• we are unable to fulfil the order for operational, logistical or legal reasons; or

• we are required to do so in order to comply with applicable laws or regulations.

Where an order is cancelled after payment has been received, we will refund any amounts paid using the original payment method without undue delay.

Nothing in this section affects any rights you may have under applicable consumer protection laws.

                          

DELIVERY

Please see SHIPPING AND RETURNS for information on costs of delivery. We will use our reasonable endeavours to ship the goods or services within the times indicated.

However, where delivery times and dates are given, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control. Under no circumstances will we ship any items if we have not received full payment for the price of the goods that you have ordered on the Sites.

 

CANCELLATION BY US

ANABELA CHAN reserves the right to cancel the contract between you and us if we:

• have insufficient stock to deliver goods you have ordered;

• do not deliver to your area; or

• if one or more items you ordered was listed at an incorrect price due to a typographical error.

If we decide to cancel your contract we will send you an email to notify you and re-credit to your account any amount deducted by us from your credit card as soon as possible (in any event within 30 days of your order). Except where required by applicable law, we shall not be liable for any indirect loss, inconvenience or disappointment arising from such cancellation.

We may send you marketing communications and newsletters where you have requested them or where otherwise permitted by applicable law. You may unsubscribe at any time using the unsubscribe link included in our communications.

 

The ANABELA CHAN JOAILLERIE mobile message service (the "Service") is operated by ANABELA CHAN JOAILLERIE (“ANABELA CHAN JOAILLERIE”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to ANABELA CHAN JOAILLERIE’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of ANABELA CHAN JOAILLERIE through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with ANABELA CHAN JOAILLERIE. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to ANABELACHAN or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other ANABELA CHAN JOAILLERIE mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

LIABILITY

If you believe a product is damaged, defective, incorrectly supplied, or not as described, please contact us as soon as reasonably possible.

We will investigate the matter and, where appropriate, may:

• Make good any shortage or non-delivery;
• Replace any goods that are damaged, defective, incorrectly supplied, or not as described; or
• Provide an appropriate refund using the original method of payment where reasonably practicable.

Nothing in these Terms excludes, limits or affects any rights or remedies that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

 

INTELLECTUAL PROPERTY RIGHTS

All content available on this Site, including but not limited to photographs, images, illustrations, designs, jewellery creations, trademarks, logos, graphics, text, software, HTML, CSS and other code, together with the overall design, appearance and functionality of the Site (the "Content"), is owned by, licensed to, or otherwise controlled by Anabela Chan Limited and is protected by applicable copyright, trademark, design, intellectual property and other laws.

ANABELA CHAN™, Anabela Chan Limited and all related names, logos, product names and designs are trademarks, registered trademarks or other intellectual property rights of Anabela Chan Limited or its licensors.

The Site and its Content are provided solely for your personal, non-commercial use. You may view, download or print portions of the Site solely for the purpose of browsing the Site, placing an order or using the Site as a shopping resource.

Except as expressly permitted by law or with our prior written consent, you may not reproduce, copy, modify, distribute, publish, display, transmit, create derivative works from, sell, licence, commercially exploit or otherwise use any Content, in whole or in part.

Nothing contained on the Site shall be construed as granting any licence, right or interest in any intellectual property rights belonging to Anabela Chan Limited or any third party.

 

LEGAL GOVERNANCE

Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law.

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights to rely on such mandatory provisions. Consumers may also have the right to bring proceedings in their country of residence where required by applicable law.

 

EVENTS BEYOND OUR CONTROL

We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

ELIGIBILITY TO PURCHASE

The purchase of products through the Sites is strictly limited to parties who can lawfully enter into and form contracts on the Site in accordance with English law.

In order to make purchases through the Site, you will be requested to provide your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated.

Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Site is available only to individuals and others who meet ANABELA CHAN's terms of eligibility, who have been issued a valid credit card by a bank acceptable to ANABELA CHAN, whose applications are acceptable to ANABELA CHAN and who have authorised ANABELA CHAN to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase. Purchases made on the site are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit. ANABELA CHAN reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

 

PRICING AND PAYMENT

The prices payable for goods that you order are as set out on our website. All of our prices are in UK Pounds Sterling. You will be billed in UK Pounds and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card.

Payments can be made by Visa, MasterCard, American Express.

Payments will be debited and cleared from your account upon receipt of your order by ANABELA CHAN. If the issuer of your payment card or method refuses to authorise payment to ANABELA CHAN, we will not be liable for any delay or non-delivery.

To help ensure that your shopping experience is safe and secure we keep our software and hosting PCI (Payment Card Industry Data Security Standard (PCI DSS)) compliant.

Payments are processed using PCI DSS-compliant payment providers and industry-standard encryption technologies. Please don't try to send orders via email, as we cannot guarantee any secure transmission of details. If you're still worried about security over the Internet, then please contact us by email and we will call you back at your convenience.

 

RETURNS, EXCHANGES AND CANCELLATION RIGHTS

ANABELA CHAN is committed to ensuring your satisfaction with our creations and services.

For online purchases, eligible creations may be returned or exchanged within 14 days of delivery, subject to the conditions set out in our Refund Policy.

To be eligible for a return or exchange, creations must be returned in their original, unworn condition, accompanied by all original packaging, certificates, documentation and security tags.

Unless the creation is faulty, damaged or supplied in error, return shipping costs, duties, taxes and any associated fees may be deducted from the final refund or credit amount. Any promotional discounts applied to the original purchase will not be refunded.

We do not offer returns, refunds or exchanges for bespoke, commissioned, personalised, engraved, custom-sized, made-to-order or pre-order creations.

For the purposes of these Terms, a pre-order creation refers to a creation that is not held in stock and is produced specifically in response to a client's order, including creations from previous collections or creations made upon request. As these creations are individually created in response to a client's order and would not otherwise be produced for stock, they are considered made-to-order creations.

Except in relation to faulty, defective or incorrectly supplied goods, and subject to applicable consumer protection laws, such creations are not eligible for return, exchange or refund.

Consumers residing within the European Union may have additional statutory cancellation and withdrawal rights as set out in our Refund Policy.

 

EXCHANGE PROCEDURE

Please contact our Client Care team at info@anabelachan.com to request a return or exchange authorisation.

Once approved, we will provide detailed return instructions and, where applicable, arrange a secure courier collection from your preferred address.

All returned creations must be securely packaged and accompanied by all original certificates, documentation and packaging.

Unless the creation is faulty, damaged or supplied in error, return shipping costs may be deducted from the final refund or credit amount.

Returns and exchanges remain the responsibility of the client until safely received and accepted by ANABELA CHAN.

Once your return has been received and inspected, we will notify you of the outcome and, where applicable, process the refund, exchange or credit note.

Original shipping charges, duties and taxes are non-refundable unless the creation was received faulty, damaged or incorrectly supplied. 

 

REPAIRS & REFURBISHMENTS

In the unfortunate event that your ANABELA CHAN creation becomes damaged, we will be pleased to assist with repair or refurbishment services through our atelier. If you believe your item is faulty, please contact us as soon as possible. This does not affect your statutory rights.

Upon receipt of your creation, our atelier will assess the creation to determine whether the repair is covered under our manufacturing defect warranty. Repairs requested within 14 days of purchase or delivery, or where a manufacturing defect has been identified, will be carried out free of charge.

Repairs that fall outside the scope of the manufacturing defect warranty may be subject to an additional fee. Where applicable, a quotation will be provided for your approval before any work is undertaken.

Please note that it is the client's responsibility to arrange shipment of the creation to our atelier, including any applicable shipping costs, duties and taxes. We recommend that all creations are shipped using a secure and fully insured service. ANABELA CHAN cannot accept responsibility for creations lost, stolen or damaged in transit while being shipped to our atelier by the client.

In the unlikely event that a creation purchased through our Online Boutique is believed to be faulty, please contact us as soon as reasonably possible and our Client Care team will be delighted to assist.

GIFT CARDS

We offer you the opportunity to purchase Gift Cards on our website which will be sent to your stated delivery address.

The Gift Card will carry a unique code which can be used during check out on our website to deduct the amount stated on the Gift Card from your total purchase. Gift Cards are valid for 12 months from the date of issue. Our Gift Card is not a cheque guarantee, credit or charge card.

Gift Cards may be redeemed only for eligible purchases made through www.anabelachan.com.

Gift Cards cannot be used to purchase ANABELA CHAN products on any other online store except www.anabelachan.com. Our Gift Cards cannot be redeemed or exchanged for cash. When you use your Gift Card, the amount of your purchase will be deducted from the balance stated on your Gift Card.

If you do not spend all of your balance we will issue an additional Gift Card with your remaining balance to use at a later point. Gift Cards cannot be combined with other promotional offers, Gift Cards or Credit Notes.

 

INVALIDITY

If any part of these terms and conditions is unenforceable, unlawful or for any reason unenforceable, including any provision in which we exclude our liability to you, the enforceability of any other part of these conditions will not be affected.
