Where you do not accept these Terms and Conditions in full, you do not have permission to access the contents of this website, then please immediately stop using the site.
The images of the creations on our Website are for illustrative purposes only. We have made every effort to display the colours accurately, but we cannot guarantee that a device’s display of the colours accurately reflects the colour of the final creations. Please kindly note that your creations may vary slightly from those images.
GENERAL
ANABELA CHAN™ and www.anabelachan.com is a e-commerce service operated by Anabela Chan Limited, referred to as, "we", "us" "our" "ANABELA CHAN" in this agreement.
ANABELA CHAN™ and www.anabelachan.com website (described as "site" or "Sites" in this agreement) and related services are made available to you to the following Terms & Conditions for Use ("TCU") and any other rules posted on our Site.
By visiting the Sites, you are accepting and consenting to the terms and practises described in the TCU. We hold the right to modify the TCU from time to time.
Your continued use of this Site (or any of our other Sites) following such change shall signify your agreement to be bound by the modified TCU. Please read our Terms & Conditions for Use and check back often. If you disagree with any changes made to the TUC, then please immediately stop using the site.
PRIVACY
You acknowledge and agree to be bound by the terms of our privacy policy effective from December 2020 in accordance to the General Data Protection Regulation.
CONTRACT BETWEEN YOU AND ANABELA CHAN
Before your order can be accepted we must receive payment in whole for the price of the goods that you order.
Once payment has been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide in your order form.
Our acceptance of your order brings into existence a legally binding contract between us, concluded in London, England and the language of the contract is English.
To order goods and to transact through this site, you must be entitled to enter into legally binding contracts. Individuals unable to perform legally binding contracts are prohibited from ordering goods using the Sites.
If you do not qualify do not use this site, ANABELA CHAN holds the right to refuse to process a transaction or order for any reason at any time.
DELIVERY
Please see SHIPPING AND RETURNS for information on costs of delivery. We will use our reasonable endeavours to ship the goods or services within the times indicated.
However, where delivery times and dates are given, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control. Under no circumstances will we ship any items if we have not received full payment for the price of the goods that you have ordered on the Sites.
CANCELLATION BY US
ANABELA CHAN reserves the right to cancel the contract between you and us if we:

have insufficient stock to deliver goods you have ordered;

do not deliver to your area; or

if one or more items you ordered was listed at an incorrect price due to a typographical error.
If we decide to cancel your contract we will send you an email to notify you and re-credit to your account any amount deducted by us from either your credit card or PayPal account as soon as possible (in any event within 30 days of your order). We cannot offer any additional compensation for disappointment suffered.
NEWSLETTER
We might send you our ANABELA CHAN newsletter from time to time to the e-mail address you have provided during your purchase or when using the contact form. You can unsubscribe any time by clicking the 'unsubscribe' link at the bottom of our newsletter or by sending an email with the subject 'unsubscribe' to customerservice@anabelachan.com.
MOBILE TERMS OF SERVICE
The ANABELA CHAN JOAILLERIE mobile message service (the "Service") is operated by ANABELA CHAN JOAILLERIE (“ANABELA CHAN JOAILLERIE”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to ANABELA CHAN JOAILLERIE’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of ANABELA CHAN JOAILLERIE through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with ANABELA CHAN JOAILLERIE. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to ANABELACHAN or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other ANABELA CHAN JOAILLERIE mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

LIABILITY
If any products we deliver to you are damaged, defective, of an incorrect quantity or not what you ordered, we shall have no liability to you unless you notify us by e-mail of the problem within 7 working days of the delivery of the products. If you notify us of a problem, our obligation will be to either,
- To make good any shortage or no-delivery;
- To replace any goods that are damaged or defective;
- To refund you the amount paid by you for the goods in question in whatever way we choose.
INTELLECTUAL PROPERTY RIGHTS
You agree and acknowledge that all designs, logos, copyright, trademarks and all other intellectual property and material rights relating to the Content of this Site, including Anabela Chan Software and all HTML, CSS and other code contained in this Site, shall remain at all times with the Sites, unless otherwise stated.
Such Content, including third party trademarks and copyrights displayed or mentioned on the Sites are protected by national or international property and other laws.
You are only permitted to use the Content as authorised in written by ANABELA CHAN. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties.
LEGAL GOVERNANCE
Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law.
The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.
EVENTS BEYOND OUR CONTROL
We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
ELIGIBILITY TO PURCHASE
The purchase of products through the Sites is strictly limited to parties who can lawfully enter into and form contracts on the Site in accordance with English law.
In order to make purchases through the Site, you will be requested to provide your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated.
Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.
The Site is available only to individuals and others who meet ANABELA CHAN's terms of eligibility, who have been issued a valid credit card by a bank acceptable to ANABELA CHAN, whose applications are acceptable to ANABELA CHAN and who have authorised ANABELA CHAN to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase. Purchases made on the site are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit. ANABELA CHAN reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.
PRICING AND PAYMENT
The prices payable for goods that you order are as set out on our website. All of our prices are in UK Pounds Sterling. You will be billed in UK Pounds and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card.
If you are buying from outside the UK, you will also incur any duties levied by the jurisdiction to which you have specified delivery. Payments can be made by Visa, MasterCard, American Express as well as PayPal and Coinbase Commerce Pay.
Payments will be debited and cleared from your account upon receipt of your order by ANABELA CHAN. If the issuer of your payment card or method refuses to authorise payment to ANABELA CHAN, we will not be liable for any delay or non-delivery.
To help ensure that your shopping experience is safe and secure we keep our software and hosting PCI (Payment Card Industry Data Security Standard (PCI DSS)) compliant.
This is the same level of encryption used by large banks to keep your information secure. Please don't try to send orders via email, as we cannot guarantee any secure transmission of details. If you're still worried about security over the Internet, then please contact us by email and we will call you back at your convenience.
YOUR SATISFACTION GUARANTEE AND RIGHTS TO CANCEL YOUR CONTRACT
ANABELA CHAN guarantees your total satisfaction with our products and services. We do not offer refunds on our creations purchased in person. We are happy to exchange or offer a credit note for unworn items with security tags untouched within 7 days of in-store purchase.
Refunds for online orders can be requested within 14 days of the date of delivery, and exchanged within 30 days from the date of despatch. If you choose to exchange your item outside of the 14 day refund policy, a refund will not be offered for the exchanged item unless the product is faulty. Please note that any promotional discount as well as return shipping costs will be deductible from the final credit amount.
Unfortunately, we cannot accept items that have been engraved, personalised or altered. We do not offer returns & refunds for custom and bespoke creations, as well as pre-order creations.
Please kindly note that except in relation to faulty or incorrectly supplied goods, where your statutory rights are unaffected, bespoke creations made to a customer's specifications may not be returned.
EXCHANGE PROCEDURE
Please request an Exchange Authorisation within 14 days of receiving the order by emailing sales@anabelachan.com.
The item(s) must be packed securely in the packaging in which you have received it. We will not accept the exchange if the jewellery item is damaged or worn. Please enclose any additional items (jewellery box, promotional gifts). Make sure the security tag is left on. We only accept items with their original security tag.
If not returned in person to our Flagship Boutique at 35B Sloane Street, Knightsbridge, SW1X 9LP, London, U.K., you will be required to pay for the return courier fee of the item to us via our secure courier service. Please contact our dedicated client service team at sales@anabelachan.com or on + 44 (0)20 7823 2700 who will be delighted to assist you.
An exchange or a credit note will be issued if the item is in its original condition and all the information referred to above is received.
Goods that are damaged or not in the original condition will not be accepted for exchange or credit note.
ANABELA CHAN reserves the right to deduct the direct costs of recovering the goods from the amount credited to you including the shipping fees.
Any promotional discount will be deductible from the final credit note.
REPAIRS
In the unfortunate event that your piece becomes damaged, we will be happy to carry out repair works in our atelier.
Once we receive your creation our atelier will assess whether the repair is approved under manufacturing defect warranty. Repairs within 14 days of purchase or delivery or in case it has been determined there is a manufacturing issue with the creation will be carried out free-of-charge. Non-warranty repairs will be subject to an additional fee based on the job required, which will be submitted to you for your approval prior to the job being carried out.
Please kindly note that it is the client's responsibility to ship the creations to the atelier, inclusive of any customs duties and taxes. Please contact our dedicated client service team at sales@anabelachan.com or on + 44 (0)20 7823 2700 who will be delighted to assist you.
In the unlikely event that the item you purchased from our Online boutique is believed to be faulty, please contact us within 14 days from receipt and our dedicated team will be able to assist you.

GIFT CARDS
We offer you the opportunity to purchase Gift Cards on our website which will be sent to your stated delivery address.
The Gift Card will carry a unique code which can be used during check out on our website to deduct the amount stated on the Gift Card from your total purchase. Gift Cards are valuable for 12 months from date of issue. Our Gift Card is not a cheque guarantee, credit or charge card.
The recipient of our Gift Card(s) may use the card to purchase good(s) on our website the Sites or its' associated subsets.
Gift Cards cannot be used to purchase ANABELA CHAN products on any other online store except www.anabelachan.com. Our Gift Cards cannot be redeemed or exchanged for cash. When you use your Gift Card, the amount of your purchase will be deducted from the balance stated on your Gift Card.
If you do not spend all of your balance we will issue an additional Gift Card with your remaining balance to use at a later point. Gift Cards cannot be combined with other promotional offers, Gift Cards or Credit Notes.
COPYRIGHTS, TRADEMARKS & COMMERCIAL USE
You agree and acknowledge that all materials including photographs, images, illustrations, designs, layout, text or script, including software and HTML and other code contained in this Site are part of the Sites and are protected by copyright, trademark and/or other intellectual property rights owned, controlled or licensed to ANABELA CHAN. The contents of the site and the site as a whole are intended solely for personal, non-commercial use. You may download or copy the contents and other downloadable materials displayed on the site for the sole purpose of placing an order with ANABELA CHAN or using the site as a shopping resource. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the contents, the site, or any related software.
INVALIDITY
If any part of these terms and conditions is unenforceable, unlawful or for any reason unenforceable, including any provision in which we exclude our liability to you, the enforceability of any other part of these conditions will not be affected.
WARRANTY
As a consumer you are entitled to various statutory warranties including a warranty that the products supplied to you conform to your contract with us.
Anabela Chan Limited guarantees a warranty period of twelve months on all creations starting from the date of purchase. Proof of purchase from authorised International Stockists is required to validate the warranty.
We will offer complimentary repair services during the warranty period if it is a manufacturing or material defect. Please note cracking, chipping or scratching of stones as well as gold-plating wear are not considered as manufacturing defects. This warranty does not cover normal wear and tear. It is not valid in case of loss, theft, improper use, negligence or attempts to repair it by unauthorised persons.
All creations outside of the warranty period will incur a repair fee. Please contact our Fine Jewellery Assistants for further information.
AUTHENTICITY GUARANTEE
We guarantee the authenticity of all products purchased through the Website.
